What clients should know: On 27 October 2026, the Labour Department (LD) announced an administrative sanction on two employers under the Enhanced Supplementary Labour Scheme (ESLS). Status: administrative sanction announced / case date 27 October 2026 — not a new law commencement and not a cancellation of the ESLS. Deadline / next step: for the named employers, processing of submitted ESLS applications has been terminated with immediate effect, and ESLS applications from them will be refused for one year from that date; other employers should treat accurate full-time local-employee figures and continuous 2:1 manning as live compliance requirements, and seek professional advice rather than DIY application steps.

The Government Information Services Department (政府新聞處) published the English press release on 27 October 2026 (HKT 12:00). The named employers are Pionier Laundry Limited and Coucou (HK) Catering Management Company Limited.

What sanction did the Labour Department impose?

With immediate effect, the LD terminated the processing of applications for importing labour previously submitted by the two companies under the ESLS. In parallel, from 27 October 2026 the LD will refuse to process any ESLS applications submitted by those companies for a period of one year.

Why were the two employers sanctioned?

After investigation, the LD established that the companies had breached ESLS requirements after importing labour under the scheme, for two stated reasons: (i) providing the LD with false information on the number of full-time local employees; and (ii) failing to fulfil the 2:1 manning ratio of full-time local employees to imported workers continuously.

What does the ESLS require of employers?

The LD spokesman stressed that employers applying to import workers under the ESLS must strictly comply with scheme requirements, including according priority to employing suitable local workers. The release states that if an employer violates labour or immigration laws, ESLS requirements, or the Standard Employment Contract, the LD will impose an administrative sanction. Such sanctions may include terminating the processing of submitted applications, withdrawing approvals for importation of workers previously granted, and refusing subsequent applications.

This article is a compliance signal for Hong Kong employers who use — or are considering — the ESLS. It is not a DIY guide to complete ESLS applications, not immigration DIY, not company-secretarial DIY, and not a guarantee of any application outcome. Forms, quotas, and official procedures remain with the Labour Department and its published scheme materials.

What should other employers ask a professional adviser?

Useful orientation questions (not DIY steps): whether workforce records for full-time local employees match what would be reported to the LD; whether the continuous 2:1 full-time local to imported worker ratio is monitored after importation; how Standard Employment Contract and labour/immigration compliance are documented; and when to pause new ESLS filings until internal records are verified. HKBSCL can help clients frame compliance and workforce-governance questions and coordinate with appropriate professionals — without replacing the LD’s statutory process or teaching a self-serve application route.
